1. Acceptance of Terms

By accessing or using the Prometheus Coach mobile application and website (the "Service"), operated by Peakforce OÜ ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

Prometheus Coach is an AI-powered fitness coaching platform that provides personalized training programs, exercise form analysis, and health-related guidance. The Service uses artificial intelligence and is not a substitute for professional medical advice, diagnosis, or treatment.

Important: Always consult a qualified healthcare provider before starting any new fitness program. You use the Service at your own risk.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate information and keep it up to date. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to create an account. If you are below the age of digital consent where you live — in the EU and EEA this is set nationally and ranges from 13 to 16 — you need permission from a parent or guardian. Users under 13 cannot access the community features.

We reserve the right to suspend or terminate accounts that violate these terms or remain inactive for an extended period.

4. Subscriptions & Payments

Some features require a paid subscription. Subscriptions are billed through the Google Play Store or Apple App Store ("Store"). Payment terms, renewal, and cancellation are governed by the respective Store's policies.

• Free trials may be offered; you will be charged when the trial ends unless you cancel beforehand
• Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends
• Refunds are handled by the respective Store according to their refund policies

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to develop a competing product
• Upload malicious content or interfere with the Service's operation
• Share your account credentials with third parties
• Scrape, crawl, or otherwise extract data from the Service in an automated manner

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, AI models, algorithms, and software — are owned by Peakforce OÜ and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any personal data and content you provide. By using the Service, you grant us a limited license to process your data as described in our Privacy Policy.

7. AI-Generated Content

The Service uses artificial intelligence to generate training recommendations, form analysis, and coaching advice. AI-generated content is provided "as is" and may not always be accurate or appropriate for your individual circumstances.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. Always use your own judgment and consult professionals when needed.

8. Limitation of Liability

To the maximum extent permitted by law, Peakforce OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health, resulting from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for any injuries sustained while following training recommendations.

10. Termination

You may terminate your account at any time through the app settings or by contacting us. We may terminate or suspend your account for violating these terms. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia and applicable European Union regulations. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

If you are a consumer in the EU, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
